A. Notice and Takedown Procedure

If you believe that your copyrighted work has been infringed on wandercove.com, you can submit a DMCA notice to our designated agent. Our designated agent is:

Ashley Bailey
Creative Manager
WanderCOVE
11516 Ceres St, Lorena, Texas 76655, United State
+1 (254) 312-8689
[email protected]

Your DMCA notice must include the following information:

  • A description of the copyrighted work that you believe has been infringed. This should include the title of the work, the author, and the date of publication.
  • A description of the infringing content. This should include the URL of the infringing content and a brief description of the content.
  • Your contact information. This should include your name, address, phone number, and email address.
  • A statement that you have a good faith belief that the infringing content is not authorized by the copyright holder.
  • A statement that you are the copyright holder or are authorized to act on behalf of the copyright holder.
  • You can submit your DMCA notice by mail, email, or fax. We recommend that you submit your DMCA notice by mail or fax, so that you have a record of your submission.

Once we receive your DMCA notice, we will review it to determine if it meets the requirements of the DMCA. If your DMCA notice meets the requirements, we will remove or disable access to the infringing content.

The infringing party may then submit a DMCA counter-notice. If we receive a DMCA counter-notice, we will review it to determine if it meets the requirements of the DMCA. If the DMCA counter-notice meets the requirements, we will restore access to the infringing content.

B. Counter-Notice Procedure

If you have received a notification about alleged copyright infringement of your design or merchandise on WanderCOVE, but believe it was issued in error or under a misinterpretation, you have the right to submit a counter-notice to our designated agent listed in Section A.

Your counter-notice must include the following information:

  • Identification of the removed or disabled content: Provide a clear description of the content, including its location on WanderCOVE before it was removed.
  • Statement of good faith belief: Declare under penalty of perjury that you believe the content was removed or disabled due to a mistake or misidentification.
  • Your contact information: Include your full name, mailing address, telephone number, and email address.
  • Consent to jurisdiction: State that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located, or if outside the USA, for the judicial district in which WanderCOVE is located. You must also agree to accept service of process from the party who originally submitted the DMCA notice.
  • Your signature: Provide your electronic or physical signature.

Upon receiving your counter-notice:

  • WanderCOVE will send a copy to the original complaining party, informing them of the potential reinstatement of the content within 10 business days.
  • The original complaining party has 10-14 business days to file a copyright infringement lawsuit against you in the designated court.
  • If no lawsuit is filed, WanderCOVE may, at its discretion, restore or re-enable access to the disputed content within the aforementioned timeframe.

Please note:

  • Filing a false counter-notice can expose you to significant legal liabilities.
  • We recommend seeking legal advice if you have any doubts or complexities regarding the counter-notice process.
